Common financial sources that may impact CVC assistance
These are examples of sources of payment that might affect CVC payments if they cover the same expenses:
- Auto or medical insurance
- Medicaid/Medicare
- Lawsuit settlements or judgments
- Restitution
- Disability/unemployment benefits
- Burial or life insurance
- Social Security Disability (SSDI)
- Police officer or teacher benefits
What is subrogation?
Subrogation is the process through which the Crime Victims' Compensation (CVC) Program recovers funds it has paid when a victim later receives money from other sources (for e.g. a lawsuit or insurance) for the same expenses.
Advocates, please help victims understand:
- Subrogation is not a penalty: Subrogation prevents double payment for the same expense
- Their total support won't decrease: They're still entitled to all eligible expenses
- The process is required by law: This isn't a discretionary decision
